“Israel is an apartheid state.”

Israel as a whole is described as a system of racial domination comparable to South Africa, so it is illegitimate and must be dismantled like apartheid South Africa was.

  1. Why people find it convincing

    • In the West Bank, Israeli settlers live under Israeli civil law while Palestinians next door live under military law and military courts — two legal systems on one territory, divided by nationality.
    • Major human rights organisations reached the apartheid conclusion after long investigations: B'Tselem (Israeli, January 2021), Human Rights Watch (April 2021), Amnesty International (February 2022).
    • Palestinians in the West Bank need permits to move, build, or reach their land; roads, checkpoints and the barrier shape their lives, while settlers move freely.
    • In its July 2024 advisory opinion on the occupation, the International Court of Justice found that Israel's legislation and measures in the occupied territory breach Article 3 of the Convention on the Elimination of Racial Discrimination, which prohibits racial segregation and apartheid.
    • Former Israeli officials and diplomats, and some South African anti-apartheid veterans, have used the word themselves.
  2. What's true

    In the West Bank, two legal systems by nationality are real — documented in Israel's own law, not only in NGO reports.

    The primary evidence is Israeli: the Knesset's emergency regulations on the West Bank (the 'Judea and Samaria' jurisdiction regulations, renewed about every five years) apply Israeli criminal law personally to Israelis there, while Palestinians on the same land fall under military orders and military courts. Two populations, one territory, different law by nationality, with one side holding political power over the other for more than half a century. The ICJ's 2024 advisory opinion found that Israel's legislation and measures in the occupied territory breach Article 3 of CERD (racial segregation and apartheid) — a judicial finding. The legal label itself (Rome Statute Art. 7(2)(h): an institutionalised regime of systematic oppression and domination by one racial group over another, with intent to maintain it) remains contested in its application; the West Bank facts behind it are not seriously in dispute, and supporters of Israel who deny them lose credibility.

  3. What's left out

    Inside Israel's 1949 lines, the picture is different — unequal, but not apartheid in the South African sense.

    About 2 million Arab citizens of Israel vote and are elected; Arab parties sit in the Knesset; an Arab Muslim justice, Khaled Kabub, sits on the Supreme Court; an Arab Islamist party (Ra'am) was part of the governing coalition in 2021. Real inequality exists — in land allocation, planning, funding — and the 2018 Nation-State Law declared national self-determination unique to the Jewish people, which Arab citizens rightly experience as demotion. That is discrimination to be fought, as in many democracies with national minorities; it is not the legal disenfranchisement that defined South African apartheid. Gaza since 2005 is a third, different situation (blockade, Hamas rule, now war).

    About the human rights reports: one cluster, not three independent confirmations.

    B'Tselem (January 2021), Human Rights Watch (April 2021) and Amnesty International (February 2022) reached the apartheid conclusion, and are often cited together as if they were three separate findings. They cite one another and draw on overlapping sources (largely the same Israeli and Palestinian NGOs), so their agreement is weaker evidence than it looks; critics have challenged specific sourcing and legal reasoning in them. Treat them as a well-argued position resting on the primary facts above — and check any individual claim in them against its primary source before repeating it.

    The strongest evidence concerns the occupied territory; the slogan applies it to the state itself, and the proposed remedy ('dismantle it like South Africa') targets the state's existence rather than the occupation. That is the same slide as 'occupation since 1967' becoming 'occupied since 1948'. Precision helps the Palestinian case more than the slide does: 'the West Bank regime of two legal systems must end' is a claim most of the world, and many Israelis, can accept.

    If the objection is the West Bank regime, the remedies are known: an end to the occupation through a negotiated state, or equal rights under one law. If the objection holds only once Israel ceases to exist, 'apartheid' is doing the work of an argument that should be made openly — including what happens to the ~7 million Jews living there.
